Education law can cover a variety of topics and span a number of practice areas, including constitutional, contract, civil rights, employment, and consumer law.
Student/parent-guardian rights
The issue of student rights can come up in the context of actions taken by a school regarding conduct or academic performance or integrity. For example, a student and/or parent-guardian may need legal advice, guidance, or representation with respect to a disciplinary proceeding or a change in academic status. Student and parent/guardian rights can also relate to contractual and tuition-based issues with a school.
faculty/teacher rights
Faculty and teacher rights involve employment law issues. In addition to traditional employment issues, such as discrimination, retaliation, and harassment, a faculty member may require legal advice on issues relating to tenure, grants, research, and authorship. Faculty members and teachers also may need legal advice and/or representation relating to complaints, grievances, and/or disciplinary proceedings.
Title ix
Title IX protects people (students, parents-guardians, faculty/teachers, other employees, applicants) from discrimination based on sex in education programs or activities that receive federal financial assistance. Examples of Title IX violations are sex and LGBTQ discrimination, sexual harassment, on-campus sexual assault, and retaliation.
